1. Acceptance

By accessing or using TrackMX, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. These Terms are beta-stage terms and still require review by qualified legal counsel once the service operator and jurisdiction are confirmed.

2. Beta service

TrackMX is pre-release software offered to a limited cohort for evaluation and feedback. Features, coverage, integrations, data, and availability may be incomplete, delayed, inaccurate, changed, suspended, or removed. You may encounter defects or lose access. Keep independent copies of important ride, maintenance, schedule, and safety information.

Garmin and Apple Health connections may be unavailable even when related interface or code exists. Manual import and venue confirmation remain important fallbacks. Feedback may be used to improve TrackMX, but we do not promise to implement any suggestion.

3. Rider safety and track information

TrackMX is a planning aid—not a venue, emergency, weather, medical, timing, or safety authority.

Track status, schedules, conditions, closures, directions, events, and imported source updates can be stale, incomplete, misclassified, or changed after publication. Before traveling or riding, confirm current status, conditions, rules, and schedule directly with the venue. Follow venue staff, posted rules, sanctioning-body requirements, local law, weather warnings, and your own qualified judgment.

Motocross and off-road riding involve serious risk, including injury, death, and property damage. Wear appropriate protective equipment, ride within your ability, inspect your motorcycle and equipment, and never use TrackMX data to encourage unsafe speed, airtime, riding while injured, or disregard of track rules. Telemetry, jump ranges, confidence indicators, maintenance reminders, and derived statistics are informational estimates and are not professional advice.

4. Eligibility and accounts

You must provide accurate account information, keep access to your sign-in method secure, and promptly report suspected unauthorized use. You are responsible for activity under your account. Do not share verification codes or attempt to access another rider’s account.

The beta is not offered to children under 13 and does not yet provide age assurance or guardian consent. If you are a minor where you live, do not use TrackMX unless the operator has expressly opened an age-appropriate program and your parent or legal guardian has reviewed and agreed as required by law.

5. User content

You keep ownership of content you submit, such as profile information, track corrections, geometry, photos, reports, posts, setup notes, and feedback. You grant TrackMX a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as needed to operate, secure, moderate, improve, and provide the service according to your selected visibility and these Terms. This license ends when the content is deleted, except for reasonable technical completion time and content that must remain in de-identified, shared-community, legal, or safety records.

You represent that you have the rights and permissions needed to submit the content and that it is accurate to the best of your knowledge when presented as a factual correction or safety-sensitive update. Public-source track updates remain attributed to their source and are not represented as your content.

6. Acceptable use

You may not use TrackMX to:

  • harass, threaten, exploit, impersonate, or expose another person’s private or precise location information;
  • post deceptive track status, unsafe encouragement, unlawful content, malware, spam, or content you do not have the right to share;
  • scrape, probe, overload, reverse engineer where prohibited, bypass access controls, or interfere with the service or another account;
  • misuse notifications, source attribution, reporting, appeals, or support systems;
  • use ride estimates or community information as proof of legal compliance, medical fitness, venue safety, race results, or insurance eligibility; or
  • use TrackMX in violation of applicable law or a connected provider’s terms.

TrackMX may review, limit, hide, remove, or preserve content to enforce these Terms, protect riders, respond to reports, comply with law, or maintain source integrity. Supported moderation actions may be appealed through the app or support.

7. Third-party services and links

TrackMX may link to venues, event organizers, map providers, Apple, Garmin, public social sources, and other third parties. Their services, content, availability, and terms are their own. A link, import, or source label is not an endorsement or a guarantee. Your use of an optional integration is also subject to that provider’s terms and permissions.

8. TrackMX rights

The TrackMX service, brand, design, software, and original materials—excluding user content and attributed third-party content—are owned by the TrackMX operator or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, revocable, non-transferable right to use the beta as provided.

9. Suspension, termination, and deletion

You may stop using TrackMX at any time and may request account deletion through Settings → Account & data or email support. The present flow first locks down visibility and alerts, then support completes an audited purge or de-identification process as described in the Privacy Policy.

We may limit, suspend, or terminate access, remove content, or end the beta if reasonably necessary for security, legal compliance, provider requirements, service integrity, material breach, risk to riders, or discontinuation. Where practical and lawful, we will give notice and an opportunity to export supported account data.

10. Service changes and availability

We do not promise continuous availability, complete geographic or venue coverage, successful notification delivery, or compatibility with every phone, watch, file, or provider. Maintenance, provider outages, source changes, bad connectivity, and beta defects can interrupt the service. We may update these Terms as the beta changes; material changes will be posted with a new effective date.

11. Warranty disclaimer

To the maximum extent permitted by applicable law, TrackMX is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, safety, or uninterrupted operation. Some jurisdictions do not allow certain disclaimers, so those limits may not apply to you.

12. Limitation of liability

To the maximum extent permitted by applicable law, the TrackMX operator and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, opportunity, goodwill, or profits; missed events; travel costs; equipment damage; or injury arising from reliance on service information or use of the beta. Nothing in these Terms excludes liability that cannot legally be excluded.
